TRUSTEE’S NOTICE OF FORECLOSURE SALE THAT UNDER AND BY VIRTUE OF AUTHORITY vested in the undersigned Trustee and in execution of that certain Deed of Trust made by Ricky Darrell Blackburn, Sr. a.k.a. Rick Blackburn dated the 29th day of November, 2010 and recorded in Trust Deed Book 259, page 437 in the Register’s Office for Johnson County, Tennessee, default having been made in the payment of the indebtedness thereby secured, the undersigned Trustee at the request of the holder of said Note will offer for sale at public auction at the front of the Courthouse in Mountain City, Tennessee on the 1st day of May, 2019, at 11:00 a.m. (E.T.) the following described parcel of land and improvements: SITUATE and lying in the Ninth Civil District of Johnson County, Tennessee and being more particularly bounded and described as follows, to wit: BEGINNING at a point witnessed by an iron pin nail in fence in the general southern edge of the roadway and/or right-of way of Wallace Road, a corner to Allen Snyder; thence, with the line of Snyder and existing fence as follows: south 26°, 35’, 05″ east, 2 25.29 feet to a post; thence, south 26°, 34’, 54″ east, 93.11 feet to an iron pin found at fence corner; thence, south 52°, 57’ 52″ east, 106.78 feet to a post; thence, south 54°, 18’, 54″ east, 69. 62 feet to an iron pin found at fence corner in the line of Douglas; thence, with the line of Douglas and existing fence south 41°, 46’ 18″ west, 344.23 feet to an iron pipe found; thence, in line of partition of the property of Magic, Inc., north 37°, 38’, 05″ west, 546.36 feet to an iron pin set in the general southern edge of the roadway and/or right-of-way of Wallace Road; thence, north 37°, 38’, 05″ west, 15.00 feet to a point in the general centerline of said road; thence, with the general centerline of said road as follows: north 46°, 03’, 47″ east, 76.19 feet to a point; thence, north 48°, 28’, 25″ east, 60.07 feet to a point; thence, north 52° , 21’, 31″ east, 59.76 feet to a point; thence, north 56°, 25’, 17″ east, 61.69 feet to a point; thence, north 59°, 14’, 50″ east, 96.61 feet to a point; thence, leaving the centerline of said road south 29°, 54’, 47″ east, 12.53 feet back to the point of BEGINNING containing 3.955 acres, more or less, as surveyed by Ricky Lynn Snyder, R.L.S. # 1910, and a plat or plan of the same being attached hereto as an exhibit to the deed to Rick Blackburn recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 162, page 407 to which reference is had and made for further description. EXCEPTING and RESERVING from the above property in easement fashion is any part or portion there constituting the roadway and/or right-of-way of the Wallace Road. BEING that same tract or parcel of land which was conveyed to Rick Blackburn pursuant to deed from Patricia Best McCreary dated the 4th day of September, 2003 recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 162, page 407. If applicable, the notice requirements of T.C.A. Section 35-5-117 have been met. TERMS OF SALE; CASH. A bidder’s deposit of ten percent (10%) will be required. The entire amount of the successful bid must be paid in full, in cash within forty eight (48) hours after sale. Purchaser shall pay all recording fees, examination of title, settlement fees, and all costs of conveyance, including preparation of a Deed of bargain and sale by Special Warranty. The sale is subject to conditions, restrictions, rights-of-way, easements and reservations contained in the deeds forming the chain of title to this property. Any improvements on subject property will be sold in “as is” condition without warranty of any kind.
